Privacy Policy

At Nobimobil S.A.S. ("Nobimobil", "we") we respect your privacy and comply with Ecuador's Organic Law for the Protection of Personal Data (LOPDP) and its Regulation. This policy explains what data we collect, why we process it, how we treat it and what rights you have over it.
1. Data controller
Nobimobil S.A.S., tax ID (RUC) 1793214785001, registered at Av. Amazonas N39-123 y José Arízaga, Amazonas Plaza Building, 7th floor, office 704, Quito – Pichincha, Ecuador. Data protection contact: privacy@nobimobil.com.
2. Data we collect
We collect: (a) identification data (name, ID card or passport, date of birth), (b) contact data (email, phone, address), (c) financial data (bank account, source of funds), (d) browsing data (IP, device, cookies as per our Cookie Policy) and (e) data you provide voluntarily when subscribing to the newsletter (name and email).
3. Purposes of processing
We use your data to: (a) provide the platform service, (b) meet KYC and anti-money-laundering obligations reportable to UAFE, (c) send you commercial communications about investment opportunities —with your prior consent—, (d) improve service security and (e) comply with legal, tax and accounting obligations before SRI and the Superintendency of Companies.
4. Legal basis
We process your data based on: (a) your express consent when registering or subscribing, (b) the execution of the loan agreement when you participate in a project, (c) compliance with Ecuadorian legal obligations and (d) the legitimate interest in ensuring platform security.
5. Recipients
We share data with: (a) the Ecuadorian bank that operates the escrow account, (b) the notary and the Property Registry to record mortgages, (c) UAFE when the rules require it, (d) the tax authority (SRI) for tax purposes and (e) technology providers under a data processor agreement. We do not sell or transfer data for advertising purposes to third parties.
6. Retention period
We keep your data for the duration of the contractual relationship and, thereafter, for the periods required by tax law (7 years), company law and anti-money-laundering law (10 years). Newsletter subscribers' data is kept until you unsubscribe.
7. Your rights
You may exercise the rights of access, rectification, erasure, opposition, portability and objection to automated processing by writing to privacy@nobimobil.com attaching a copy of your ID. You may also lodge a complaint with the Superintendency for the Protection of Personal Data of Ecuador.
8. Security
We apply reasonable technical and organisational measures: TLS 1.3 encryption in transit, AES-256 encryption at rest, role-based access control, audit logging and annual penetration testing by an independent third party.
9. Changes to this policy
Any amendment will be published on this page with the date of the last update. If the change affects your rights, we will notify you by email at least 15 days in advance.
